These Terms of Service and End-User License Agreement (the “Terms”) govern your access to and use of the website at www.hawaiianbeautyproducts.com and the related ordering, inventory, and business-management services operated by Hawaiian Beauty Products (“Hawaiian Beauty Products,” “we,” “us,” or “our,” and together the “Services”).

End-User License

Products and Pricing

Orders and Payment

When you place an order, you are offering to purchase a product subject to these Terms. All orders are subject to acceptance and availability. Payment must be received prior to order processing. For invoiced professional accounts, payment is due within the terms stated on the invoice, and late balances may be subject to a finance charge as described on the invoice.

Shipping and Delivery

Shipping times are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers or customs. Risk of loss transfers to you upon delivery to the carrier.

Returns and Refunds

We accept returns within 30 days of purchase for unused items in original packaging. Professional products may not be returned once opened. Defective items will be replaced or refunded. Approved refunds are processed to the original payment method, typically within 5–10 business days after we receive the return.

Third-Party Services

The Services integrate with third-party providers — including Intuit QuickBooks Online for accounting and inventory, along with payment processors, shipping carriers, and email providers. Your use of those integrations is also subject to the respective third party’s terms and privacy policies. We are not responsible for third-party services, and their availability may change. Accounting data accessed through QuickBooks is handled as described in our Privacy Policy.

Intellectual Property

The Services, including their content, design, logos, and software, are owned by Hawaiian Beauty Products or its licensors and are protected by intellectual property laws. Except for the limited license granted above, these Terms do not transfer any right, title, or interest in the Services to you.

Disclaimers

The Services and products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Hawaiian Beauty Products will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services or a product will not exceed the amount you paid for the product or service giving rise to the claim.

Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Honolulu, Hawaii will have exclusive jurisdiction over any dispute arising from these Terms or the Services.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above. Your continued use of the Services after an update means you accept the revised Terms.
